Terms of Service
Last updated: 18 June 2026
This is a plain-language summary of the terms that govern your use of TouringMate. It is a draft pending legal review and does not replace formal legal terms โ for specific questions, reach us at info@touringmate.com.
Parties & scope
These Terms form a binding agreement between Tribe Music Group AG (operating the TouringMate brand), Altgasse 43, CH-6340 Baar, Zug, Switzerland, company number CHE-443.757.160 ("TouringMate", "we", "us"), and you. They govern your access to and use of the TouringMate website and the app at app.touringmate.com, including any free and paid plans (together, the "Service"). If you accept these Terms on behalf of a band, label or other entity, you confirm you have authority to bind it.
The service
TouringMate helps touring artists plan tours and audit their GEMA royalties by matching tour data against GEMA payouts and generating reports and claim documents. Its outputs are provided for your own analysis and decision-making and do not constitute legal, tax, financial or accounting advice.
Eligibility & your account
You must be at least 18 and able to enter into a binding contract. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity under your account. Notify us promptly at info@touringmate.com if you suspect unauthorised access.
Plans & payment
TouringMate is free for one artist, with paid plans for larger rosters and teams as described on our pricing page. Paid fees, where applicable, are billed as set out at sign-up, are exclusive of VAT unless stated otherwise, and you can cancel at any time with effect from the end of the current billing period.
Your data & inputs
You retain ownership of the data you upload, including your GEMA statement files (ABR CSVs) and tour details. You grant us the limited licence needed to host and process that data to operate the Service and generate your reports. You are responsible for the accuracy and legality of the data you provide, and you confirm you are entitled to upload it. We do not sell your data.
Acceptable use
You may use TouringMate only for lawful purposes and only with data you are entitled to use. You may not attempt to disrupt, reverse-engineer or circumvent the security of the Service, use it to build a competing product, resell it without our consent, or upload malicious or infringing content.
No guarantee of royalty outcomes
TouringMate helps you identify potentially unmatched or missing royalties and prepare claim documents, but we do not control GEMA and cannot guarantee that any claim will be accepted or that any specific amount will be recovered. All figures are estimates that depend on the quality of the data you provide. You remain responsible for verifying outputs before acting on them.
Intellectual property
The Service โ including its software, interfaces, designs, models and methods (other than your data) โ remains the property of Tribe Music Group AG or its licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Service in accordance with your plan. Reports generated for you may be used for your own purposes and shared with your professional advisers.
Disclaimers & limitation of liability
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind. We are not liable for indirect or consequential losses, lost royalties, or loss of data, and our total aggregate liability is limited to the fees you paid us in the 12 months before the claim, or EUR 100 if you have not paid any fees, whichever is greater. Nothing excludes liability that cannot be excluded by law.
Data protection
We process personal data in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the GDPR. How we handle your account and contact data is set out in our Privacy Policy, which forms part of these Terms.
Changes to these terms
We may update these Terms from time to time. Where changes are material, we will take reasonable steps to inform you. Your continued use of the Service after the changes take effect means you accept the updated Terms.
Governing law & disputes
These Terms are governed by the laws of Switzerland, excluding its conflict-of-law rules and the CISG, and the courts of Zug, Switzerland have exclusive jurisdiction. If you are a consumer in the EU/EEA, you keep the protection of the mandatory consumer laws of your country of residence and may use the EU online dispute resolution platform at ec.europa.eu/consumers/odr.
